Client Waiver & Release

1. Applicants/Clients of the Center may benefit from the advice provided by others, including but not limited to the Center's staff, Board, and volunteers. Although the advice rendered is believed to be valid, such advice is normally predicated upon what may be incomplete knowledge of any particular situation, and no representations of any kind are made with respect to the quality of that advice.


2. I/we acknowledge that the Center's staff and Board had broad discretion to recommend approval or denial of any application to be a client. For instance, they will consider many subjective factors, including but not limited to the client demonstrating the background, attitude, and experience to make the business successful; how many jobs may be created; and the long-term sustainability of my/our business or industry. However, in no event will the Center be entitled to improperly discriminate against me/us or my/our business on the basis of race, color, sexual orientation, religion, disability, age, veteran status, ancestry, or national or ethnic origin.


3. Applicant/Client(s) is advised to consider all advice and counsel available to them from all sources prior to making any substantive decisions regarding the operation and management of its business.


4. I/we hereby release the Center, its agents, employees, insurers, and/or volunteers from any and all liability for any damages or injuries that may be incurred arising from, or in any way related to, my/our participation in the Center's programs and services. I/we agree to defend, indemnify, and hold the Center, its staff, Board, and volunteers harmless from and against all demands, claims, actions, causes of action, damages and liabilities, asserted against the Center by reason of or resulting from participation in the Center's programs and services. This release includes claims based on equal protection or discrimination as well as claims of any type whatsoever that I/we may have with regard to the potential disclosure of confidential or private information, including any information that may be considered proprietary information or a trade secret. This release extends to all types of claims, including claims based on negligence or breach of contract.


5. I/we acknowledge that I/we had the opportunity to review this document prior to signing it.


6. This document shall be construed according to Colorado law. The prevailing party in any litigation arising out of the document shall be entitled to recover reasonable attorneys' fees and costs.
